These Terms and Conditions (“Terms”) govern your use of the website thebrandmighty.com and the services offered by The Brand Mighty, a strategic growth consultancy operating under Mettler Design Inc., a company registered in Delaware, United States.

The Brand Mighty operates as a strategic consulting and marketing services division of Mettler Design Inc.

All service agreements, contracts, and formal engagements may be executed under either:

depending on the nature of the engagement.

The scope, pricing, and terms of any services will be defined in a separate service agreement or contract between the client and The Brand Mighty or Mettler Design Inc.


4. Conditional Performance Guarantee

While marketing outcomes depend on various external factors, The Brand Mighty may offer a performance-based guarantee under specific service programs.

This guarantee applies only when all guarantee terms and operational requirements provided by The Brand Mighty are fully met by the client.

If the client fulfills all conditions outlined in the Guarantee Terms & Conditions, and the agreed performance benchmark is not achieved within the initial 30-day performance period, the client may choose one of the following options:

Option 1 — Continue the Engagement
The Brand Mighty will continue working with the client without charging additional service fees until the agreed benchmark or first measurable result is achieved, as defined in the applicable agreement.

Option 2 — Terminate the Engagement
The client may request termination of the service agreement after the 30-day evaluation period if the agreed benchmarks are not achieved and all guarantee conditions were met.

Advertising spend, platform fees, and third-party costs are not included in the guarantee and are non-refundable.

Any case studies, performance examples, or metrics shown on this website are provided for illustrative purposes only and do not represent guaranteed outcomes unless explicitly stated within a written service agreement.


5. Client Responsibilities

Clients engaging in our services are responsible for:

  • providing accurate information about their business
  • maintaining access to required accounts and platforms
  • implementing recommendations when applicable
  • maintaining adequate product inventory and operational capacity

Failure to fulfill these responsibilities may affect the effectiveness of our services.


6. Payments

Payment terms, billing schedules, and service fees will be defined in the applicable service agreement.

Unless otherwise stated:

  • Service fees are non-refundable once services have begun, except where a performance guarantee applies and the conditions of that guarantee are met.
  • The performance guarantee evaluation period is 30 days from the start of the engagement, provided all operational conditions are satisfied.
  • Advertising spend, platform fees, and third-party costs are not included in our service fees.
  • Late payments may result in suspension or termination of services until payment obligations are fulfilled.

7. Intellectual Property

All materials, strategies, frameworks, and content created by The Brand Mighty remain the intellectual property of The Brand Mighty / Mettler Design Inc., unless otherwise agreed in writing.

Clients are granted a limited license to use deliverables for their business operations.

Clients may not reproduce, resell, or distribute proprietary materials without written permission.


8. Third-Party Platforms & Access Requirements

Our services may involve the use of third-party platforms including but not limited to:

• Meta (Facebook / Instagram)
• Google Ads
• Shopify
• Analytics and tracking platforms

To properly perform our services, the client agrees to provide appropriate administrative or operational access to any relevant accounts, platforms, or tools required for campaign management, tracking implementation, or performance analysis.

Failure to provide necessary access may limit our ability to perform services effectively and may affect performance outcomes.

The Brand Mighty is not responsible for changes, outages, restrictions, or policy decisions made by these third-party platforms.


9. Limitation of Liability

To the fullest extent permitted by law, The Brand Mighty and Mettler Design Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our website or services.

This includes but is not limited to:

• loss of revenue
• business interruption
• loss of data
• advertising performance fluctuations

Our total liability shall not exceed the amount paid for services during the previous billing period.


10. Confidentiality

We respect the confidentiality of our clients and treat all shared business information as private.

Similarly, clients agree not to disclose proprietary strategies, materials, or processes provided by The Brand Mighty without written permission.


11. Termination

We reserve the right to terminate services or website access if:

• these Terms are violated
• unlawful or unethical activities are detected
• cooperation between parties becomes unworkable

Specific termination conditions will be outlined in the applicable service agreement.


12. Changes to These Terms

We may update these Terms and Conditions from time to time.

Any updates will be posted on this page with the revised “Last Updated” date.

Continued use of the website after updates constitutes acceptance of the revised Terms.


13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

30-Day Growth Guarantees

Terms & Conditions

The Brand Mighty offers a 30-day performance guarantee designed to align incentives between our team and our clients. To ensure fair evaluation and accurate performance measurement, the following conditions must be met by the client throughout the duration of the engagement.

Failure to meet these conditions may void the guarantee.


1. Minimum Advertising Budget

The client must maintain a minimum advertising spend between $7,000 and $10,000 USD per month during the engagement period.

This budget is required to generate statistically meaningful data and to properly test campaigns, creatives, and optimization strategies.

The guarantee does not apply if the advertising budget falls below the agreed minimum threshold.


2. Implementation of Website Recommendations

If the client is responsible for website development or technical implementation, all optimization recommendations provided by The Brand Mighty must be implemented within 36 hours of receipt.

These changes may include but are not limited to:

  • landing page improvements
  • product page adjustments
  • tracking configuration updates
  • conversion optimization elements

Delays in implementation may significantly affect performance outcomes and may void the guarantee.


3. Accurate Data & Tracking Requirements

The client must maintain fully functional and accurate tracking systems prior to onboarding.

This includes:

  • Meta Pixel
  • Google Analytics 4 (GA4)
  • conversion event tracking

Tracking systems must have a minimum of 60 days of historical data available before the start of the engagement to ensure proper analysis and campaign planning.

If tracking is inaccurate or incomplete, performance measurement cannot be guaranteed.


4. Product Availability

The client must maintain inventory availability for at least 80% of their core SKUs throughout the 30-day growth sprint.

Advertising campaigns cannot perform effectively if promoted products become unavailable or frequently go out of stock.

If inventory limitations disrupt campaign continuity, the guarantee may be voided.


5. Communication & Responsiveness

The client agrees to maintain timely communication with The Brand Mighty team.

All client communications related to campaign approvals, asset requests, or implementation feedback must be responded to within 24 hours.

Delays in communication may impact campaign performance and the ability to execute time-sensitive optimizations.


6. Guarantee Scope

The 30-day guarantee applies only when all conditions outlined above are met throughout the duration of the engagement.

If these requirements are satisfied and the agreed performance objectives are not achieved, The Brand Mighty will continue working with the client without additional service fees until the first measurable result is achieved, as outlined in the agreement, or if the client wants to terminate the services, a complete refund shall be provided.

Advertising spend, platform fees, and third-party expenses are not included within this guarantee.


7. Good Faith Collaboration

This guarantee is built on the expectation of a good-faith partnership between The Brand Mighty and the client.

Both parties agree to work collaboratively, provide necessary resources, and act promptly on strategic recommendations to maximize the likelihood of success.
